Terms of Use

These terms are an agreement between you and First Phase LLC ("we", "us") about your use of OpenFlight OS. Please read them. They are short on purpose.

Agreeing to these terms

  • The first time you sign in after these terms take effect, we ask you to tick "I agree to the Terms and Privacy Policy".
  • We record the date you agreed and the version you agreed to.
  • If you don't agree, please don't use OpenFlight OS.

OpenFlight OS is an invite-only beta

  • You can only use OpenFlight OS if we invited you.
  • It is still being built. Features may change, break or be removed.
  • We provide it "as is" and "as available", without promises that it will always work, be error-free or keep your data forever. Download your data regularly if you need a copy.

Your content is yours

  • You own everything you put into OpenFlight OS: your Brand blueprint, Library, plans, transcripts, recordings, uploads and posts.
  • You also own the drafts the app writes for you, as far as we have any rights in them.
  • You give us permission to store and process your content only to run OpenFlight OS for you. That includes sending parts of it to the services listed in our Privacy Policy, like the AI provider that writes your drafts.
  • We don't use your content for anything else, and we don't sell it.

AI can be wrong

  • OpenFlight OS uses AI to write plans, drafts, hooks and answers. AI can get facts wrong, make things up, or sound confident when it isn't right.
  • Read and check everything before you post it.
  • You are responsible for what you post, including:
    • health, medical, legal and financial claims;
    • claims about results, clients or credentials;
    • following each platform's rules and the law where you post.
  • OpenFlight OS does not give medical, legal or financial advice.

Using OpenFlight OS fairly

Please don't:

  • post content through or from OpenFlight OS that is illegal, harmful, hateful, harassing or misleading;
  • upload content you don't have the right to use;
  • try to get into another person's account or data;
  • break, overload or reverse-engineer the app;
  • share your sign-in or let someone else use your account without our permission.

We may suspend or close an account that breaks these rules.

Your account

  • Keep your password safe. You are responsible for what happens in your account.
  • Tell us at privacy@forcomstudios.com if you think someone else has used it.

Ending your account

  • You can leave any time. If you own the account, go to Settings → Your data → Delete my account and type the account's name. The account is locked right away and permanently deleted 7 days later; until then you can undo it by signing in and choosing "Keep my account". After the 7 days, we permanently delete your content, your uploaded files and your login (your login stays only if you also belong to another OpenFlight OS account), and it can't be undone. Copies in backups are removed within another 30 days.
  • Producers can't delete an account. A producer can only leave it.
  • Download first if you want a copy. Settings → Your data → Download my data gives you one file with all your data, plus links to download your uploaded files. The links work for 7 days, and you can download again anytime to get fresh ones.
  • We can end the beta or your access. We'll try to give you 30 days' notice by email so you can download your data, unless you broke these terms or the law requires us to act sooner.

Our responsibility

As far as the law allows, First Phase LLC is not responsible for:

  • anything you post, or what happens because you posted it;
  • lost content, lost income or other indirect losses from using, or not being able to use, OpenFlight OS.

As far as the law allows, our total responsibility to you for anything to do with OpenFlight OS is limited to the greater of $100 or what you paid us in the last 12 months.

Changes to these terms

  • We may update these terms. When we do, we'll change the date and version at the top.
  • If the change is important, we'll email you 30 days before it takes effect, and ask you to agree again in the app before you keep using OpenFlight OS.

Law that applies

These terms are governed by the laws of Ohio, United States. Any dispute will be handled in the courts of Ohio.
